TERMS AND CONDITIONS

WHOLESOME ALCHEMY CONTRACT

This booking agreement is between Wholesome Alchemy known as and referred to in this agreement as “Wholesome Alchemy” AND
the individual attending the retreat referred to in this agreement as the “participant”.

Terms and Prices

This agreement between Wholesome Alchemy and the participant is for the booking of rooms, meals and the use of the facilities for a yoga retreat as described below:

Domestic Retreats:
Commuter ($1,000), Dorm ($1,400) Double ($1,600), Private ($1,800) Shared Private ($3,000)

International:
Dorm Space ($2,600), Private Room ($3,100), Shared Private ($5,000)

Payment

All payments for this booking shall be made by the participant directly to Wholesome Alchemy. Upon executing this agreement the participant shall pay to Wholesome Alchemy a deposit of $1.000. The final payment is 60 days prior to the retreat.

If the participant fails to pay pursuant to the payment schedule, the booking pursuant to this agreement is canceled and all payments made are forfeited.

Booking Changes and Cancellations

Wholesome Alchemy often books up months in advance. Wholesome Alchemy depends upon these early bookings to sustain itself. For a variety of reasons that include remoteness, airfare availability, how people plan their vacations and the fact Wholesome Alchemy may have turned away viable alternatives, the participant by booking a substantial part of Wholesome Alchemy, acknowledges that Wholesome Alchemy would suffer serious hardship if it makes substantial changes or cancellations to its booking. Hence, Wholesome Alchemy and the participant agree to the following:

If the participant books additional rooms, this payment schedule will be adjusted to reflect those additions. If the participant desires to change rooms they can do so freely up to 30 days prior to arrival, depending on availability. If the participant desires to change rooms within 30 days of arrival it will be at the sole discretion of Wholesome Alchemy.

If the participant desires to cancel s/he may do so up to 60 days prior to the arrival without penalty. If the participant cancels any rooms within 60 days of the arrival s/he will be liable for the deposit of those bookings without any credit or repayment based on the sole discretion of Wholesome Alchemy.

There is no refund for unused services. For example, if a participant leaves early or is unable to come for whatever reason Wholesome Alchemy will not make any refund. If the participant cancels its reservation within 30 days, all payments are forfeited and will be construed as liquidated damages.

Responsibility and Risk

The participant acknowledges that they may be going to a developing country and that their first world expectations of how things work may or may not exist in another country. Additionally, the customs of another country may be substantially different than those in North America. The participant must appreciate that in developing countries services in all aspects of another country’s life including hotels, tours and restaurants cannot be expected to be of the same standard as those in the North American Countries. The term “reasonable standard” must be interpreted accordingly. Additionally, given the remoteness of the location and Wholesome Alchemy’s natural setting there may be minor adjustments to the day-to-day schedule of the group activities. The participant acknowledges that there is inherent risk in traveling to remote areas in third world countries and participating in a yoga retreat and its attendant activities. Furthermore, many of the yoga retreat activities will be under the sole supervision and guidance of the participant.

To the fullest extent of the law, the participant hereby releases and absolves Wholesome Alchemy, its agents, employees, and invitees thereof from any and all damages resulting from death or personal injuries, including loss of services, which it or its group members may sustain on account of, arising from, or in connection with the yoga retreat or its stay at Wholesome Alchemy.

All activities at Wholesome Alchemy carry inherent risks. The nature of a yoga retreat is adventurous, and participation involves a degree of personal risk. Everyone will be visiting places where the geographical attributes present dangers and physical challenges greater than those present in their daily lives, and they will be participating in yoga activities that may challenge the body physically and mentally. It is the participant and its members responsibility to acquaint themselves with all possible relevant travel information and the nature of their itinerary; and to take responsibility for any injuries they may incur through the practice of yoga while on the yoga retreat. Each group member may be asked by the Wholesome Alchemy to sign liability releases.

Wholesome Alchemy will use every reasonable effort to make the yoga retreat safe and successful for the participant and its members. If the participant or its member have cause for complaint while at Wholesome Alchemy, the participant must bring it to the attention of Wholesome Alchemy who will then do their best to rectify the situation.

Any personal information that Wholesome Alchemy collects about the participant may be used for any purpose associated with Wholesome Alchemy in terms of sending marketing material in relation to its events and special offers. This can be individually revoked at any time with written notice to Wholesome Alchemy. Wholesome Alchemy does not sell or give personal information on any guest unless required by law.

INFORMED CONSENT AND LIABILITY WAIVER RELEASE FOR PROGRAM PARTICIPATION

I agree and consent to the following when I attend a Wholesome Alchemy retreat:

I am voluntarily participating in a transformational retreat conducted by Wholesome Alchemy. I recognize that the retreat requires physical exertion that may be strenuous at times and I am fully aware of the risks and hazards involved.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the above-mentioned program. I represent and warrant that I have no medical condition that would prevent my participation in the program.

I agree to assume full responsibility for any risks, injuries or damage known or unknown which I might incur as a result of participating in the program. Such injuries may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness, including death.

I knowingly, voluntarily, and expressly waive any claim I may have against Wholesome Alchemy for injury or damages that I may sustain as a result of participating in the retreat.

I have read the above waiver and release of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above.

MEDIA RELEASE FORM

I understand that my likeness, image, video presence, voice or other reproduction may be used for Wholesome Alchemy for advertising, website images, media, or other purposes. I understand that unless I opt out of this release, my likeness may be used without my specific permission as deemed appropriate by Wholesome Alchemy.

I hereby give Wholesome Alchemy consent to record, videotape and photograph my image and/or voice to be used in the following ways WHEN I ATTEND A RETREAT:

Company website accessible to anyone
Wholesome Alchemy Academy accessible to members
Internet accessible via the World Wide Web to anyone
Printed public newsletters and emails to subscribers

I further understand that no special compensation will be provided to me for use of my image and that I may not be informed in advance of the specific use of my image.
